Personal Choice Payment Protection

 

IMPORTANT NOTICE
Altra Federal Credit Union is making term and condition changes to the Personal Choice Payment Protection Program effective 12/1/2008. Claims for any protected events that occur before this date will be processed under the current terms and conditions of your agreement. As of 12-1-08, all protected events will be handled under the new terms below:

Home Equity changes
• Home Equity packages with disabil-ity and involuntary unemployment will provide protection to age 70 since members are working longer. Previously protection terminated at age 65.

• Home Equity packages that included involuntary unemployment protection will now have more protection. The $2,000 per period of involuntary unemployment Protec-tion maximum is being increased to $3,000.

• Home Equity life protection is being increased from $50,000 to $100,000 of the protected
outstanding loan balance in the event of death.

• The disability claim history shows that the majority of disabilities are lasting for 12 months or less. There-fore, Home Equity packages with disability protection that are currently 18 months or a $6,000 maximum will now be changing to 12 months or a $12,000 maximum.

• All closed-end second mortgages that were protected under the Con-sumer Packages will now be switched to the Home Equity packages and have the same terms, conditions & fees as the Home Equity packages. The fees will increase based on the enhanced benefits for Option 6, Loss of Life, from $0.054 to $0.093 (for single protection) and from $0.090 to $1.69 per $100 (for joint protec tion) of your outstanding loan balance.

Additional Consumer changes

• Consumer packages with disability and involuntary unemployment will provide protection to age 70 since members are working longer. Previously protection terminated at age 65.

• The disability claim history shows that the majority of disabilities are lasting for 12 months or less. There-fore, Consumer packages with disability protection will be changing from 18 months or $12,000 to 12 months or $12,000.

Enrollment in Personal Choice Payment Protection is optional and can be canceled any time.
Personal Choice Payment Protection is a convenient way to safeguard your loans, your family, your collateral, and your credit rating against unforeseen events.


 

Bill Payment Agreement

 

Service Provider
You authorize Altra Federal Credit Union (Altra) to utilize Metavante Corporation (or another processor of our choice) to provide this service to you on the Credit Union's behalf.

Definitions:

  • Processing Date: The date you choose to initiate payment to the payee. Your checking account should be debited within two business days.

  • Cutoff Time for Payment Instructions: You may enter, edit, or delete payments up until 8:00 p.m. Central Time (CST) on the business day prior to the Processing date.

  • Business Day: Monday through Friday, excluding Federal Reserve holidays.

  • Fees: The fees and charges associated with Bill Payment are disclosed in the Schedule of Fees and Charges which accompanies this Disclosure and Agreement.

Schedule of Fees and Charges

Personal Checking Accounts
Altra members with an Altra personal checking account are allowed to use the Access 24 bill payment system at no charge.

Fees
Altra has the right to change fees at any time with 30 days notice. Additional fees will not be assessed without notice to you.

NSF Fees
If you do not have sufficient funds in your account to cover a payment, you will be charged a $30 NSF fee by Altra and a $30 Merchant NSF Fee by Metavante. Altra strongly urges all Access 24 Bill Pay users to set up overdraft protection and to use the balance notification option available in Access 24 Online Banking.

Stop Payment Fee
The fee for a Bill Payment stop payment is $30. Stop payments can only be placed on checks, not ACH transactions.

Cancelled Check Copy Fee
The fee to obtain a copy of a Bill Payment cancelled check is $5.00 per copy.

Collection of Fees
In the event funds are not available in your checking account on the date a fee is charged, we reserve the right to collect the fee from any non-IRA account on which you are listed as the Owner or Joint Owner. If we are unable to collect the monthly fee within thirty (30) days, we may terminate your subscription to Bill Payment service without notice.

Scheduling Payments

Subject to the terms and conditions of this Agreement, you authorize us, and any third party acting on our behalf, to choose the most effective method to process your payment, including, without limitation, electronic (ACH), paper, or some other draft means. When possible, payments will be made electronically. However, some payments will be made by check.
You must allow at least three (3) business days between the processing date and due date (not the grace or late payment date) for electronic payments and at least five (5) business days for check payments. If you do not allow sufficient time to process a payment, or enter an incorrect due date, the Credit Union is not liable for any service or late charges levied against you.

Payment Confirmation

For each properly instructed payment to an eligible vendor, you will receive a transaction confirmation number. Unless you receive a confirmation number, we shall not be liable for any failure to make a payment, including any finance charge or late fees incurred as a result.
Subject to the limitations discussed in this Agreement, if you follow the procedures described in this agreement for payments, and you are assessed a penalty or late charge, we will reimburse you for that late charge up to a maximum amount of $15.00. If you do not adhere to the obligations described in this Agreement, or if you schedule a payment less than five business days before a vendor's due date, you will assume full responsibility for all penalties and late fees.

Restrictions
Payments may only be made in U.S. dollars to a payee with a U.S. address. Each payee must appear on the payee list you create with the Credit Union, and the account you are paying must be in your name.
You may not use Access 24 Bill Payment service to make payments to a federal, state, or local government or tax unit, payees outside the United States, or to other categories of payees we may establish from time to time.
The Credit Union reserves the right to refuse to make any payments, but will notify you of any such refusal within three (3) business days following receipt of your payment process date.

Canceling Payments

You may cancel or modify a payment and/or transfer up to 8:00 p.m. CST on the business day prior to the processing date you schedule for the payment and/or transfer to be deducted from your checking account.

Failed Payments
If a non-sufficient funds (NSF) condition exists, the ACH payment debit will be returned via banking channels. The ACH return will prompt the system to block your bill payment account, preventing you from making more bill payments until the NSF condition is resolved. Any future recurring payments scheduled for release during the time the account is blocked will not be sent.

The Credit Union is not responsible to notify you if sufficient funds are not available in your account. The Credit Union is not liable for any damages you incur if:
The estimated time allowed for delivery to the payee is inaccurate

  • You provide incomplete or incorrect payee information
  • There are delays in mail delivery
  • There are changes to the merchant address or account number
  • Any merchant fails to account for the payment in a timely manner
  • Any other circumstance occurs beyond the control of the Credit Union
  • Your Bill Payment Service has been cancelled

Errors In Bill Payments
If you select an electronic payee address that matches your payment coupon exactly and the Bill Payment processor routes the payment to a different payment center, the Bill Payment processor is responsible for the late charge and will reimburse any payee-imposed late fees, up to $50.00. If you select an electronic payee with an address that is different from that indicated on the payment coupon, you are responsible for the late charge. You have the option to manually set up a payee with the correct address as found on the payment coupon.

Right to Impress a Lien
The Credit Union shall have a lien or the right to impress a lien on your shares and deposits for sums due the Credit Union. Such a right will not apply to shares or deposits held pursuant to Individual Retirement Accounts, self-employed plans under the Internal Revenue Code, or any other deposits for which lien rights would disqualify said deposits from special benefits or preferences provided under the Internal Revenue code.

Bill Payment Stop Payments
Stop payments cannot be placed on ACH payments, only on check payments. Please contact Altra at 608-787-4500 or toll-free at 800-755-0055 to place your stop payment request(s). There is a $30 charge for each stop payment request.

General Disclaimer

Altra Federal Credit Union (Altra) hereby disclaims any warranties, endorsement, or representations, express or implied, related to any product, service, advertisement, or other information contained herein. This includes any content contained, distributed, linked, or downloaded from the site. Any products or services from this site are to be used at your own risk, with no obligations or liabilities by Altra. It will be within the sole discretion of Altra to correct any errors or to omit any portion of the services, products, or materials contained herein. This Agreement, any separate instructions, and the applicable fees and charges may be amended by the Credit Union in the future. In the event of amendment, the Credit Union shall send notice to you either by mail to your last known address or transmit such notice of the amendment over the Bill Payment or Access 24 service. Your use of the Bill Payment or Access 24 service following the receipt of such notice constitutes acceptance of such amendment. You agree to be bound by and comply with applicable state and federal laws and regulations. These terms and conditions shall be governed by and construed with the laws of the state of Wisconsin.

Transaction Modes and Process Dates

Payments from your credit union checking account may be established as either "single" or "recurring" payments. All payments are made as single payments unless designated as recurring payments.

A single payment is established by entering the amount due and due date, specifically for a Payee's individual bill. The processing date for this payment is the date you enter into the system based on the due date of your bill. You will allow at least three (3) business days between the processing date and the due date (not the grace or late payment date) for electronic payments and at least five (5) business days for check payments

If you designate a payment as a recurring payment, you request the payment be made in the same amount to the same merchant or account on the same day every month in the future. These payments will continue until you delete the payee by following the edit/delete commands on-line or until the date you have entered as the final date of payment. The processing date for this payment is the date you enter into the system based on the due date of your bill. You will allow at least three (3) business days between the processing date and the due date (not the grace or late payment date) for electronic payments and at least five (5) business days for check payments.

Deleting or Editing Payments

Bills are either pending or processed. Pending payments are those that have not been processed. When a bill has been processed, the amount for that bill will be debited from your account within two business days. You may modify or cancel pending payment(s), because no funds have been debited from your account. You may not modify or cancel a payment that has been processed. For questions regarding payments that have been processed, contact Altra at 608-787-4500 or toll-free at 800-755-0055.

Cancellation Of Bill Payment Service
Bill Payment Service may be cancelled at any time by written request to the Credit Union. The request must include your name, address, social security number, signature and date. The Credit Union cannot cancel the service until all pending payments have cleared. If you have pending payments and do not wish to wait for them to clear, you may individually delete the pending payments by following the edit/delete commands on-line.

If you do not use Bill Payment for two consecutive billing months, we reserve the right to cancel your service.

Alterations And Amendments

These Terms and Conditions (this "Agreement"), applicable fees, and service charges may be altered or amended by the Service, and/or Altra, from time to time. In such event, the Service, and/or Altra, shall send notice to you at your address as it appears on the Service's records or in a Credit Union newsletter if the change will cause you greater cost or liability or if it will limit your access to the Service. Any use of the Service after the Service and/or the Credit Union sends you a notice of change will constitute your agreement to such change(s). Further, the Service may, from time to time, revise or update the programs, services, and/or related material, which may render all such prior versions obsolete. Consequently, the Service reserves the right to terminate this Agreement as to all such prior versions of the programs, services, and/or related material and limit access to the Service's more recent revisions and updates.

Address Or Banking Changes
You agree to promptly notify Altra in writing of any address or e-mail address change. You also agree to notify Altra in writing at least ten (10) Business Days in advance of any change in your Payment Account or your Altra Member Status.

Payee Limitation

The Service reserves the right to refuse to pay any Payee to whom you may direct a payment. The Service is obligated to notify you promptly if it decides to refuse to pay a Payee designated by you. This notification is not required if you attempt to make a prohibited payment under this Agreement.

Information Authorization
To use Bill Pay you must become a registered user. Your enrollment in the Service may not be completed if the Service cannot verify your identity or other necessary information. Through your enrollment in the Service, you agree that the Service reserves the right to request a review of your credit rating at its own expense through an authorized credit bureau. In addition, you agree that the Service reserves the right to obtain financial information regarding your account from a Payee or financial institution to resolve payment-posting problems.

Disputes

In the event of a dispute regarding the Service, you and the Service agree to resolve the dispute by looking to this Agreement. You agree this Agreement is the complete and exclusive statement of the agreement between you and the Service, which supercedes any proposal or prior agreement, oral or written, and any other communications between you and the Service relating to the subject matter of this Agreement.

Other Terms And Conditions
If you cancel your Access 24 Bill Payment service, then you agree to notify us at that time. You will be responsible for all payment instructions made prior to termination and for all other applicable charges and fees. You will cancel all outstanding payment orders before notifying us to terminate this service. We will process bill payment transfer requests only to those creditors the Credit Union has designated in the "User Instructions" and such creditors as you authorize. We will not process any bill payment transfer if the required transaction information is incomplete. We will debit the designated funds from your checking account for bill payment transfer as designated by the processing date you select. You must allow sufficient time for vendors to process your payment after they receive the payment. Please allow as much time as though you were sending your payment by mail. We cannot guarantee the time that any payment will credited to your account by the vendor. Access 24 Bill Payment Service may be temporarily unavailable due to Credit Union record updating or technical difficulties.

An unlimited number of payments are allowed per day up to a maximum daily limit of $9,999.00.

You authorize Altra Federal Credit Union to charge your designated account(s) for any transactions completed through the use of the Access 24 Bill Payment Service, including any recurring payment that you make.

You regard requests for new account services, instructions to change existing account information or services, and other communication received via Access 24 as legal endorsements. As such, all correspondence initiated via Access 24 shall command the legal authority of a written request authorized by your signature.

I Choose To Pay Bills Through Bill Payment
In the event the funds are not available in my account when making a bill payment, I may be charged a NSF fee and a Merchant NSF fee. I understand all fees are subject to change following notice to me. I agree to comply with the terms and conditions. I accept liability for all transactions made by myself, joint owners, or anyone else to whom I might give the security code. I understand that withdrawals and transfers may affect the dividend and interest earned on my account. When using Bill Payment, I authorize Altra to post payment transactions generated to the account(s) indicated. I am in full control of my account, and if at any time I decide to discontinue this service, I must provide the Credit Union with written notice. My use of Bill Payment signifies that I have accepted all of the terms and conditions of this service. I understand that payments may take up to five (5) days by check or three (3) days by ACH to reach the vendor. If I do not allow sufficient time to process a payment, or enter an incorrect due date, the Credit Union is not liable for any service or late charges levied against me.

Credit Union Rules And Regulations And Other Agreements

Your Payment Account may also be governed by other agreements between you and the Credit Union and by the Credit Union's Regulatory Rules and Regulations for your Payment Account.

Gift Card Terms and Conditions

 

Terms and Conditions
The following information applies to you once you become a member who has a gift card issued by Altra Federal Credit Union (Altra).

The following are your Altra Visa Gift Card Terms and Conditions. In these Terms and Conditions "you" or "your" means the person who has received the Altra Visa Gift Card; "we," "us," or "our," means Altra Federal Credit Union; "Card" means the Altra Visa Gift Card. Please read the following carefully and keep for your records. Upon receipt, the Gift Card should be signed immediately. By accepting and using your Card, you are agreeing to these Terms and Conditions.

Gift Card Usage

Your Altra Visa Gift Card is issued by Altra Federal Credit Union and may be used for purchases at most merchants where Visa Debit is accepted. The card may not be used at some merchants including airlines, recurring payments, non-financial money exchange establishments, hotels, gambling establishments, rental car agencies, or “pay at the pump” gasoline. (You may purchase gas by presenting the card inside to the attendant.) Some merchants, like restaurants, may attempt to submit authorizations against the card for an amount greater than the actual purchase amount. If a merchant attempts an authorization greater than the balance remaining on your gift card, it may be declined.

For Gift Cards purchased Online:
Before using your Altra Visa Gift Card, you must activate it by calling the number on the sticker on your card from you home phone number, or by registering the card at www.altra.org/visa_gift_card.htm.

For Gift Cards purchased in an Altra office:
For information about your Altra Visa Gift Card, you can register your card at www.altra.org/visa_gift_card.htm. You must sign the back before you can use your card.

This Gift Card is not a credit card. You may only use it when there is a balance remaining on the card and only up to the amount left on the card. Purchases will be deducted from your Altra Visa Gift Card until the value reaches zero. If you are given value through the use of the Card greater than the balance remaining, you will pay us on demand the amount by which your transactions exceeded the balance remaining on the Card.

The Altra Visa Gift Card is non-reloadable and cannot be reused. There will be a $2.50 monthly maintenance fee for each month there is a balance remaining on the card. This fee is waived for the first twelve months after the card activation date.

VISA purchases made in foreign countries or foreign currencies will be billed to you in U.S. dollars. The conversion rate to U.S. dollars will be determined in accordance with the operating regulations established by VISA. Currently the currency conversion rate used to determine the transaction amount in U.S. dollars is a rate selected by VISA from the range of rates available in wholesale currency markets for the applicable central processing date, which rate may vary from the rate VISA itself receives or the government mandated rate in effect for the applicable central processing date. In addition, VISA charges Altra Federal Credit Union a 1% International Service Assessment for each foreign country transaction, which will be passed through to the cardholder.

IMPORTANT NOTICE
Due to changes in Federal Regulations, after August 15, 2010, we will not authorize and pay overdrafts for the following types of transactions unless you ask us to by checking Yes on the form below.

What You Need to Know about Overdrafts and Overdraft Fees
An overdraft occurs when you do not have enough money in your account to cover a transaction, but we pay it anyway. We can cover your overdrafts in two different ways:

  1. Through the standard overdraft practices that come with your account.

  2. Through optional overdraft protection plans, such as a link to another account or line of credit, which may be less expensive than our standard practices. To learn more, call 800-755-0055 to ask us about these plans.

This notice explains our standard overdraft practices.

What are the standard overdraft practices that come with my account?
We do authorize and pay overdrafts for the following types of transactions:

  • Checks and other transactions made using your checking account number
  • Automatic bill payments

We do notauthorize and pay overdrafts for the following types of transactions unless you ask us to by checking Yes on the form below:

  • ATM transactions
  • Everyday debit card transactions

We pay overdrafts at our discretion, which means we do not guarantee that we will always authorize and pay any type of transaction. If we do not authorize and pay an overdraft, your transaction will be declined.

What fees will I be charged if Altra Federal Credit Union pays my overdraft?
Under our standard overdraft practices:

  • We will charge you a fee up to $30.00 each time we pay an overdraft.
  • If your account is overdrawn seven or more consecutive days, we will charge an additional $30.00.
  • There is no limit on the total fees we can charge you for overdrawing your account.

What if I want Altra Federal Credit Union to authorize and pay overdrafts on my ATM and everyday debit card transactions?

Funds Transfer User Agreement

 

Altra Federal Credit Union Funds Transfer User Agreement
Welcome to Funds Transfer - the next generation of on-line personal finance management.

With our fully interactive on-line money movement service (the "Funds Transfer Service" or the "Service"), you may transfer funds from any of your accounts at any financial institution to any other account held by you or another person at the same or another financial institution - referred to in this agreement as "Accounts" - assuming, of course, that the transfer is permitted by your financial institution and by law. Please take a few minutes to read this Funds Transfer Service Agreement (referred to throughout as the "Agreement").

Any reference to "Altra Federal Credit Union" in this Agreement includes any directors, officers, employees, contractors, service providers, agents or licensees of Altra Federal Credit Union. As used in this Agreement, the words "you" and "your" refer to you as the user of the Service; the words "we," "us," "our" and any other variation thereof refer to Altra Federal Credit Union. Acceptance of Terms
This Agreement sets out the terms and conditions (the "Terms") on which our service provider and Altra Federal Credit Union will provide and you may use the Service and forms part of a legally binding agreement between you and Altra Federal Credit Union. When you click on the "I Agree" button, you will complete an application to receive the Funds Transfer Service, and you agree to accept the Terms, including any amendments to this Agreement or any changes in the Terms. Your application may be accepted or declined by our service provider and/or Altra Federal Credit Union based on specific criteria. If you do not agree to all of the Terms, click on the "I Disagree" button. If you do not accept and agree to all of the Terms, you will not be entitled to use the Service. Altra Federal Credit Union reserves the right to change the Terms under which the Service is offered in its sole discretion at any time; however, Altra Federal Credit Union will notify you of any material change to the Terms. In most cases, you will receive the notice on-line the next time you log in; however, Altra Federal Credit Union reserves the right to notify you by e-mail or by conventional mail, in its discretion. You agree that if you continue to use the Service after we notify you of any change, you thereby accept the changes to the Terms and agree to be bound by this Agreement, as amended. If you do not accept and agree to the changes to the Terms, you will not be entitled to use the Service. You can review, download and print the most current version of this Agreement at any time by clicking on “Funds Transfer Service Agreement." If you do not agree to the changes, or if at any time you wish to discontinue your use of the Service, you can unsubscribe by clicking on "unsubscribe" from the Edit Profile page or by sending Altra Federal Credit Union an e-mail to info@altra.org or, if you prefer, by sending a registered or certified letter to Altra Federal Credit Union at 2715 Losey Blvd. S., La Crosse, WI 54601. Once your account with Altra Federal Credit Union has terminated for any reason, you will have no further right or access to use the Funds Transfer Service. To use the Funds Transfer Service you must be at least eighteen (18) years old and be a resident of the United States.

Information Authorization
By clicking on the "I Agree" box, you authorize us to verify your identity by obtaining information about your credit history from a consumer reporting agency. Altra Federal Credit Union and our service provider will obtain and use your credit information only in accordance with the Fair Credit Reporting Act ("FCRA") and other applicable law. We reserve the right to deny you access to the Service if we cannot verify your identity or other necessary information. We may approve or decline your application for the Service based upon our review of your consumer report, along with other information we deem relevant. If we deny your request to use the Service, you may obtain a free copy of the consumer report that we used from the consumer reporting agency that issued the report. In addition to obtaining a consumer report, Altra Federal Credit Union and our service provider reserves the right to obtain such additional information as we deem reasonably necessary to insure that you, or persons to whom you may transfer funds, are not using our Service in violation of law, including, but not limited to, laws and regulations designed to prevent "money laundering" or the transfer of funds to or from persons or organizations whose accounts are blocked under regulations of the Office of Foreign Asset Control (OFAC) of the United States Treasury Department.

Once you are approved for the Funds Transfer Service we may verify your Accounts that you add to the Service from time to time. You authorize us to validate the Accounts through the use of a test transfer, in which one or more low value payments will be both credited to and debited from the Account. The test credit will always occur before the test debit and will always be of the same or lesser amount, so that the balance in any of your Accounts will never be less than the actual balance.

Once the test transfer is complete we may ask you to access your Account to tell us the amount of the test credit or debit or any additional information reported by your bank with this test transfer. We may also verify Accounts through requiring the entry of information you ordinarily use to access the Account provider's web site, or by requiring you to submit proof of ownership of the Account.

User Content
Subject to Altra Federal Credit Union's Privacy Policy, you agree that Altra Federal Credit Union may use, copy, modify, display and distribute any information, data, materials or other content (the "Content") you provide to Altra Federal Credit Union for the purpose of providing the Service, and you hereby give Altra Federal Credit Union a license to do so. By submitting Content, you represent that you have the right to license such Content to Altra Federal Credit Union for the purposes set forth in this Agreement. Accounts

You understand that in order to complete fund transfers, it is necessary for Altra Federal Credit Union and our service provider to access the websites and databases of your bank and other institutions where you hold Accounts, as designated by you and on your behalf, to retrieve information and effect the fund transfers you request. By using the Service, you represent and warrant to us that you have the right to authorize and permit us to access your Accounts to effect such funds transfers or for any other purpose authorized by this Agreement, and you assure us that by disclosing and authorizing us to use such information you are not violating any third party rights. You warrant and represent that the information you are providing us with is true, current, correct and complete. You hereby authorize and permit Altra Federal Credit Union and our service provider to use information submitted by you to accomplish these purposes and to configure the Service to be compatible with the Accounts. For as long as you are using the Service, you give to Altra Federal Credit Union and our service provider a limited power of attorney and appoint Altra Federal Credit Union and our service provider as your true and lawful attorney-in-fact and agent, with full power of substitution and resubstitution, for you and in your name, place and stead, in any and all capacities, to access the Accounts, effect funds transfers as described above, with full power and authority to do and perform each and every act and thing requisite and necessary to be done in connection with effecting funds transfers, including verifying the content and authenticity of any funds transfer instruction for the purposes of security procedures applicable to Accounts, as fully to all intents and purposes as you might or could in person. Once Altra Federal Credit Union and/or our service provider has actual knowledge that you wish to cease using the Altra Federal Credit Union Service as provided in this Agreement or as otherwise permitted in this Agreement and has a reasonable opportunity to act on such knowledge, this limited power of attorney is automatically revoked; provided, however, that any act done by Altra Federal Credit Union and/or our service provider in good faith before it has actual knowledge of termination by you and has a reasonable opportunity to act on such knowledge shall be deemed to be authorized by you. You understand and agree that at all times your relationship with each Account provider is independent of Altra Federal Credit Union and your use of the Funds Transfer Service. Altra Federal Credit Union will not be responsible for any acts or omissions by the financial institution or other provider of any Account, including without limitation any modification, interruption or discontinuance of any Account by such provider.

YOU ACKNOWLEDGE AND AGREE THAT WHEN Altra Federal Credit Union AND OUR SERVICE PROVIDER ARE EFFECTING A FUNDS TRANSFER FROM OR TO ANY OF YOUR OR A RECIPIENT'S ACCOUNTS, Altra Federal Credit Union AND OUR SERVICE PROVIDER ARE ACTING AS YOUR AGENT, AND NOT AS THE AGENT OR ON BEHALF OF ANY THIRD PARTY. You agree that Altra Federal Credit Union, its affiliates, service providers and partners shall be entitled to rely on the foregoing authorization, agency and power of attorney granted by you.

YOU AGREE THAT WE SHALL NOT BE LIABLE FOR ANY COSTS, FEES, LOSSES OR DAMAGES OF ANY KIND INCURRED AS A RESULT OF (1) OUR ACCESS TO THE ACCOUNTS; (2) OUR DEBIT AND/OR CREDIT OR INABILITY TO DEBIT AND/OR CREDIT THE ACCOUNTS IN ACCORDANCE WITH YOUR FUNDS TRANSFER INSTRUCTIONS; (3) ANY INACCURACY, INCOMPLETENESS OR MISINFORMATION CONTAINED IN THE INFORMATION RETRIEVED FROM THE ACCOUNTS; (4) ANY CHARGES IMPOSED BY ANY PROVIDER OF ACCOUNTS AND (5) ANY FUNDS TRANSFER LIMITATIONS SET BY THE FINANCIAL INSTITUTIONS OR OTHER PROVIDERS OF THE ACCOUNTS.

Not all types of accounts are eligible for Funds Transfer. Be sure to check with your financial institution for restrictions regarding transfers among your retirement (401k, IRA, etc.), savings, trusts, loans, custodial, business, corporate and other account types. We are not responsible for any costs or losses incurred from fund transfers that are not permitted under such restrictions by the provider of your Account or those imposed by applicable law.

Electronic Communications

General Consent; Categories of Records
The Funds Transfer Service is an electronic, Internet based-service. Therefore, you understand and agree that this Agreement will be entered into electronically, and that the following categories of information ("Communications") may be provided by electronic means:

  • This Agreement and any amendments, modifications or supplements to it.
  • Your records of funds transfers and other transactions through the Service, including without limitation confirmations of individual transactions.
  • Any initial, periodic or other disclosures or notices provided in connection with the Service, including without limitation those required by federal or state law.
  • Any customer service communications, including without limitation communications with respect to claims of error or unauthorized use of the Service.

Any other communication related to the Service
Although Altra Federal Credit Union reserves the right to provide Communications in paper format at any time, you agree that we are under no obligation to do so. All Communications in either electronic or paper format will be considered to be "in writing." You should print a paper copy of this Agreement and any electronic Communication that is important to you and retain the copy for your records. If you do not agree to receive this Agreement or the Communications electronically, you may not use the Service.

How to Withdraw Consent
If you have registered for the Service and you wish to withdraw your consent to have Communications provided in electronic form, you must cancel any pending transfer requests (within the time period permitted by the Service cancellation policies) and stop using the Service. There are no fees to cancel a pending transfer request (as long as such cancellation is made within the time period permitted by the Service cancellation policies).

How to Update Your Records
You agree to promptly update your registration records if your e-mail address or other information changes. You may update your records, such as your e-mail address, by using the Profile page.

Delivery of Electronic Communications
Communications may be posted on the pages of the Service website or other website disclosed to you and/or delivered to the e-mail address you provide. Any electronic Communication sent by e-mail will be deemed to have been received by you when Funds Transfer sends it to you, whether or not you received the e-mail. If the Communication is posted on the Service, then it will be deemed to have been received by you no later than five (5) business days after Funds Transfer posts the Communication on the pages of the Service, whether or not you retrieve the Communication. An electronic Communication by e-mail is considered to be sent at the time that it is directed by Altra Federal Credit Union's e-mail server to the appropriate e-mail address. An electronic Communication made by posting to the pages of the Service is considered to be sent at the time it is publicly available. You agree that these are reasonable procedures for sending and receiving electronic Communications.

Hardware and Software Requirements
In order to access and retain Communications, you must have:

  • An Internet browser that supports 128-bit encryption, such as Netscape Navigator version 4.7 or above or Internet Explorer version 5.0 or above.
  • An e-mail account and e-mail software capable of reading and responding to your e-mail.
  • A personal computer, operating system and telecommunications connections to the Internet capable of supporting the foregoing.
  • Sufficient electronic storage capacity on your PC's hard drive or other data storage unit.
  • A printer that is capable of printing from your browser and e-mail software

Privacy Policy and Confidentiality
We regard your privacy and security with the utmost importance, and we are absolutely committed to safeguarding any information that you share with us. In order to provide the Funds Transfer Service, we must obtain from you certain personal information about you, your Accounts, and your transactions (referred to herein as "User Information"). You represent that you have the right to provide such User Information and that you give us the right to use the User Information in accordance with our privacy policy. All of your personal and financial information will be placed on a secure portion of our website. We do not use any persistent "cookies" on the browser to store any personal information. We have multiple levels of security that have been designed especially for us. You can see a full description of our security policy by clicking on "Security Policy". You can see a full description of our privacy policy by clicking on "Privacy Policy".

Password
To enable you, and only you, to use the Service, you will be asked to choose a password when you register and are accepted as a customer of the Service. This password is stored in encrypted form by us. You are responsible for maintaining the confidentiality of your Funds Transfer customer number and password. No one at Altra Federal Credit Union has access to your Accounts passwords or user ID's. You are responsible for uses of the Service whether or not actually or expressly authorized by you. Therefore, it is important that you DO NOT SHARE YOUR ACCOUNT NUMBER OR PASSWORD WITH ANYONE FOR ANY REASON. No one at Altra Federal Credit Union will know or need to know your password, and Altra Federal Credit Union employees will never ask for your password. If you wish to make a transfer to an Account of another person, you will be asked to provide a separate code word or phrase (the "Shared Secret") that is known only to you and to the person to whom you are transferring the funds (the "Recipient"). We recommend that you do not use commonly used words, phrases or dates. In order to complete the transfer, the Recipient must provide the Shared Secret and certain other identifying information.

YOU AGREE THAT YOU WILL NOT GIVE THE SHARED SECRET TO ANYONE EXCEPT THE RECIPIENT FOR ANY REASON. YOU FURTHER AGREE THAT YOU WILL INSTRUCT THE RECIPIENT NOT TO GIVE THE SHARED SECRET TO ANYONE ELSE FOR ANY REASON.

Contact in the Event of Unauthorized Transfer
If you believe your password or Shared Secret has been lost or stolen, or that someone has transferred or may transfer money from your Account without your permission, call: 800-755-0055 or fax: 608-787-7150 , or e-mail: info@altra.org , or write: Funds Transfer Administrator, Altra Federal Credit Union 1700 Oak Forest Drive , Onalaska, WI , 54650 .

Consumer Liability
You agree to notify us AT ONCE if you believe your password has been lost or stolen. Telephoning us promptly is the best way to protect yourself from possible losses. If you never tell us, you could lose all of the money in your account (plus all the money in your overdraft sources). However, if you tell us within 2 business days, you can lose no more than $50 if someone used your password without your permission. You can see a complete statement of all your funds transfers effected or pending at any time by clicking on the History tab. If your statement shows transfers that you did not make, notify us AT ONCE. If you do not tell us within 60 days after the transfer was posted to your statement, you may not get back any money you lost after the 60 days, if we can prove that we could have stopped someone from taking the money if you had told us in time.

Business Days
The Service will process requests for transfers on business days. Our business days are Monday through Friday. Holidays and Federal Reserve Holidays are not included.

Transfer Types and Limitations Types of Transfers
You may use your Funds Transfer password to transfer funds between any two of your Accounts about which you have provided the necessary information to funds transfer. Transfers can be between Accounts within the same financial institution or at an unrelated financial institution (although transfers between Accounts at the same institution may be effected more quickly by contacting the institution directly). You may also use the Service to transfer funds from one of your Accounts to an account of a Recipient. Specific instructions for transferring funds to an account of a Recipient are available by clicking on the "Pay anyone" tab. Some of these services may not be available at all times. We may from time to time make available additional or new features to the Service, including but not limited to, a next day service and a higher limit service. You will be approved or declined for any such additional service at our sole discretion and additional terms and conditions may apply. Please ensure that you have sufficient funds to effect any funds transfers from your Accounts. We may at any time decline to effect any funds transfers that we believe may violate applicable law.

Frequency of Transfers
We do not limit the number of funds transfers you may make; however, you may not make funds transfers in excess of the number of funds transfers allowed by the rules governing the applicable Accounts. We may from time to time for security and risk management reasons modify the limit, the frequency and the dollar amount of transfers you can make using our Service.

Dollar Amount of Transfers
You may not make funds transfers in excess of limits described on the Service. We reserve the right to change from time to time the dollar amount of funds transfers you are permitted to make using our Service. Without limiting the foregoing, in the event that your use of the Service has been suspended and reinstated as provided herein (see "Suspension and Reinstatement of Funds Transfer Service" below), you understand and agree that your use of the Service thereafter may be subject to lower dollar amount limitations than would otherwise be permitted by us.

Transfers subject to the Rules of the Accounts
Additionally, all funds transfers are also subject to the rules and regulations governing the relevant Accounts. You agree not to effect any funds transfers from or to an Account that are not allowed under the rules or regulations applicable to such accounts including, without limitation, rules or regulations designed to prevent the transfer of funds in violation of OFAC regulations.

Rejection of Transfers
We reserve the right to decline to effect any funds transfers, to submit funds transfer instructions or orders or to carry out change or cancellation requests.

Authorization
You authorize us to select any means to execute your funds transfer instructions. You understand that to effect your funds transfer instruction we utilize the Automated Clearing House (ACH), using applicable ACH Rules, we debit one of your Accounts and credit another of your Accounts or an account of a Recipient. Once your Account has been debited, we credit our service provider's transfer account at the service provider's clearing bank. After our service provider and/or its clearing bank are reasonably certain that the debit will not be returned (in most cases this is usually between 3-4 banking days), our service provider will credit your or the Recipients Account. The sole purpose for our service provider's transfer account is to complete your funds transfer requests and for performing the services within the scope of this Agreement. The service provider earns no interest on the funds in the transfer account. If the debit side fails or is returned for any reason and the credit side has been released and cannot be collected, you authorize our service provider to collect from the Account to which the credit side of the funds transfer was sent. We reserve the right to resubmit a debit, or a portion of the debit, in the event of an insufficient or uncollected funds return and if we cannot collect the amount credited. To effect this collection, you understand and authorize us to debit the credited Account or the debited Account in either the same dollar amount as the original funds transfer or a portion of the debit. There may be a fee associated with such collection imposed by the financial institution holding the Account.

You understand and agree that we may from time to time impose additional charges in connection with your funds transfer transactions. Altra Federal Credit Union will notify you of such fee in advance of the transaction. If you choose to proceed with the transaction, you authorize Altra Federal Credit Union to debit your account in the amount indicated. In the event that a debit to any of your Accounts, or any portion of any such debit, has failed and the credit side of such transaction has been released and cannot be collected, and we are unable to debit either the debited or the credited Account as set forth above, we reserve the right, and you hereby authorize us, to debit any of your other Accounts to the extent necessary to offset any resulting deficiency. We do not undertake to notify you in such event, other than by posting any such transfer or transfers to the applicable Account in accordance with this Agreement (see "Documentation," below).

You understand and agree that in the event we are unable to execute your funds transfer request utilizing the ACH, we may utilize other established payment mechanisms in order to complete your funds transfer instructions, such as wire transfer or check. If you have requested for a funds transfer to a Recipient, you must provide us with a true, correct, current email address for such Recipient. We will contact the Recipient, and ask the Recipient to provide us with certain information, such as the account number and financial institution that they wish to transfer the funds to. If the Recipient fails to reply to the email or fails to follow the instructions provided by us, we will notify you and credit your Account for the amount of the transfer.

Suspension and Reinstatement of Funds Transfer Service
In the event that we at any time incur a problem with your use of the Service, including without limitation a fail in Funds Transfer Service to debit any of your Accounts or to collect with respect to any of your funds transfers as described above, and without limiting any other right or remedy that we may have under this Agreement or otherwise, we reserve the right to suspend your right to use the Service, immediately and without prior notice to you. You understand and agree that such action is reasonable for us to take in order to protect itself from loss. In the event of such suspension, you may request reinstatement of your service by contacting us using any of the methods provided for under this Agreement (see "Error Reporting and Claims," below). We reserve the right in its sole discretion to grant or deny reinstatement of your use of the Service. In the event we agree to reinstate you, we reserve the right to, and ordinarily will, initially reinstate your Service subject to lower per-transaction and monthly dollar limits and/or with other restrictions than otherwise might be available to you. Based upon your subsequent usage of the Service, Altra Federal Credit Union in its sole discretion may thereafter restore your ability to effect transfers subject to such higher limits as may then be in effect (see "Dollar Amount of Transfers," above).

Documentation
You may access a statement of all funds transfers effected or pending at any time by clicking on the History tab. If a funds transfer could not be completed, Altra Federal Credit Union and/or our service provider, upon learning that the funds transfer has failed, will make a reasonable effort to complete the transfer again. If the funds transfer fails a second time, we will notify you to contact your financial institution or other provider of the relevant Account to learn more about the failure.

Your Responsibility for Errors
You understand that we must rely on the information provided by you and you authorize us to act on any instruction which has been or reasonably appears to have been sent by you, to submit funds transfer instructions on your behalf. You understand that financial institutions receiving the funds transfer instructions may rely on such information. We are not obliged to take any further steps to confirm or authenticate such instructions and will act on them without getting further confirmation. You understand that if you provide us with incorrect information or if there is any error in your instruction we will make all reasonable efforts to reverse or delete such instructions, but you accept full responsibility for losses resulting from any of your errors, duplication, ambiguities or fraud in the information that you provide. You agree not to impersonate any person or use a name that you are not authorized to use. If any information you provide is untrue, inaccurate, not current or incomplete, without limiting other remedies, Altra Federal Credit Union reserves the right to recover from you any costs or losses incurred as a direct or indirect result of the inaccurate or incomplete information.

Error Reporting and Claims
In case of errors or questions about your funds transfers, e-mail us at info@altra.org or telephone us at 800-755-0055 or write to us at Altra Federal Credit Union 2715 Losey Blvd S, La Crosse, WI, 54601 as soon as you can, if you think your statement is wrong or if you need more information about a transfer listed on the statement. You can see a complete statement of all your funds transfers effected or pending at any time by clicking on the History tab.

We must hear from you within 60 days after we FIRST posted the transfer to your statement. (1) Tell us your name, and the account number of the Account to which the error relates. (2) Describe the error or the transfer you are unsure about, and explain as clearly as you can why you believe it is in error or why you need more information. (3) Tell us the dollar amount of the suspected error. If you tell us orally, we may require that you send us your complaint or question in writing within 10 business days. We will determine whether we committed an error within 10 business days (20 business days for new member accounts) after we hear from you and will correct any error promptly.

If we need more time, however, we may take up to 45 days (90 days for new member accounts) to investigate your complaint or question. If we decide to do this, we will credit/debit the applicable Accounts within 10 business days (20 business days for new member accounts) for the amount you believe is in error, so that you or your intended Recipient will have use of the money during the time it takes us to complete our investigation.

If we ask you to put your question or complaint in writing and we do not receive it within 10 business days, we may not credit/debit the applicable Accounts. We will tell you the results within three business days after completing our investigation. If we decide that we did not make an error, we will send you a written explanation. You may ask for copies of the documents we used in our investigation.

We are not responsible for errors, delays and other problems caused by or resulting from the action or inaction of financial institutions holding the Account or the account of your Recipient. Although we will try to assist you in resolving any such problems, you understand that any such errors, delays or other problems are the responsibility of the relevant financial institution or the Recipient. Any rights you may have against a financial institution for such errors, delays or other problems are subject to the terms of the agreements you have with such financial institution, including any time limits during which complaints must be made.

Proprietary Rights
You acknowledge and agree that Altra Federal Credit Union and/or our service provider owns all rights in and to the Funds Transfer Service. You are permitted to use the Service only as expressly authorized by this Agreement. You may not copy, reproduce, distribute, or create derivative works, reverse engineer or reverse compile Altra Federal Credit Union and/or our service provider's Funds Transfer Service or any of Altra Federal Credit Union and/or our service provider's services or technology. No Unlawful or Prohibited Use As a condition of using the Service, you warrant to us that you will not use the Service for any purpose that is unlawful or is not permitted, expressly or implicitly, by the terms of this Agreement or by any applicable law or regulation. You further warrant and represent that you will not use the Service in any manner that could damage, disable, overburden, or impair the Service or interfere with any other party's use and enjoyment of the Service. You may not obtain or use Funds Transfer Service to obtain any materials or information through any means not intentionally made available or provided for through the Service. You agree that these warranties and representations will remain in full force and effect even if this Agreement terminates for any reason.

Service Changes and Discontinuation
We may modify or discontinue the Service or your account with us, with or without notice, without liability to you, any other user or any third party. We reserve the right, subject to applicable law, to terminate your account and your right to use the Service at any time and for any reason, including without limitation if we, in our sole judgment, believe you have engaged in conduct or activities that violate any of the Terms or the rights of Altra Federal Credit Union and/or our service provider, or if you provide us with false or misleading information or interfere with other users or the administration of the Services. We reserve the right to charge a fee for the use of the Service and any additional services or features that we may introduce. You understand and agree that you are responsible for paying all fees associated with the use of our Funds Transfer Service. You may terminate your account with Altra Federal Credit Union at any time by clicking on 'unsubscribe' from the Edit Profile page or by sending us an e-mail at info@altra.org or, if you prefer, by sending a registered or certified letter to Altra Federal Credit Union at 2715 Losey Blvd S, La Crosse, WI, 54601 . Once your account with Altra Federal Credit Union has terminated for any reason, you will have no further right or access to use the Funds Transfer Service, and Altra Federal Credit Union will not access your Accounts thereafter for any reason.

The Altra Federal Credit Union website may contain links to other websites ("Linked Sites"). Such links are provided solely as a convenience to you. Altra Federal Credit Union does not screen, approve, review or otherwise endorse any content or information contained in any Linked Sites. You acknowledge and agree that Altra Federal Credit Union, its affiliates and partners are not responsible for the contents of any Linked Sites, including the accuracy or availability of information provided by Linked Sites, and makes no representations or warranties regarding the Linked Sites or your use of them.

Security Procedures
You understand that the financial institution at which an Account is maintained may contact us to verify the content and authority of funds transfer instructions and any changes to those instructions. You understand that, as your agent, we may provide to such financial institution such information as may be required to verify the instructions and may constitute a valid security procedure under the rules governing such Account.

Deviating from Security Procedures
You agree to allow us to authorize any financial institution at which you have an Account to accept funds and transfer instructions in accordance with any authorization procedures as may be agreed from time to time between you and such financial institution, or between us, on your behalf, and such financial institution, without verifying the instructions under the established security procedures, regardless of whether such security procedures were agreed by you directly or by us on your behalf. In addition you agree that we may authorize such financial institutions to charge and debit your accounts based solely on these communications.

Account Number Policy
If funds transfer instructions identify a bank or beneficiary by name and account number, the relevant financial institution may execute those instructions by reference to the number only, even if the number does not correspond to the name. You understand that such financial institutions may not investigate discrepancies between names and numbers. In addition, you agree that we have no responsibility to investigate discrepancies between names and numbers.

Joint Account Holder
In submitting your application for the Funds Transfer Service, you confirm that, if any of your Accounts is a joint account, your joint account holder has consented for you to use your Accounts for the Service. We will end your use of the Service if any joint account holder notifies us that (i) they never consented to your use of our Funds Transfer Service, (ii) the joint account can no longer be operated on your instructions alone, or (iii) they are withdrawing consent for you to operate the joint account.

Means of Transfer
You authorize us to select any means we deem suitable to provide your funds transfer instructions to the applicable financial institution. These choices include banking channels, electronic means, funds transfer systems, mail, courier, or telecommunications services, intermediary banks and other organizations. You agree to be bound by the rules and regulations that govern the applicable funds transfer systems, such as CHIPS or automated clearing house (ACH) as published by the National Automated Clearinghouse Association (NACHA). We shall make all reasonable efforts to ensure that your transfer requests are processed on time; however, we reserve the right to hold funds beyond the normal period and if any interest is earned will be the property of Altra Federal Credit Union.

Our Liability
If we do not provide a funds transfer instruction on time, if we cause an incorrect amount to be removed from an Account or if we cause funds from an Account to be transferred to any account other than the Account or Recipient's account specified in the applicable funds transfer instruction, we shall be responsible for returning the improperly transferred funds and/or for directing any misdirected funds to the proper Account or intended recipient's account. Altra Federal Credit Union is not responsible or liable if your or the Recipient's financial institution's system fails and we are unable to complete the transfer. Except as otherwise required by law, Altra Federal Credit Union shall in no other event be liable for any losses and damages other than those arising from gross negligence or willful misconduct on our part or if we breach a representation or warranty of Altra Federal Credit Union hereunder. You agree that your transfer instructions constitute authorization for us to complete the transfer. You represent and warrant to us that you have enough money in the applicable Accounts to make any funds transfer you request that we make on your behalf through the Service. You understand and agree that we are not liable under any circumstances for any losses or damages if, through no fault of ours, you do not have enough money to make the funds transfer and the funds transfer is not completed or is later reversed or if your financial institution does not permit the transfer or the funds transfer would exceed the credit limit on any applicable overdraft line. You also understand and agree that we are not responsible for any losses or damages if circumstances beyond our control (such as fire or flood) prevent us from making a transfer or if the Altra Federal Credit Union website was not working properly and you knew about the breakdown when you started the funds transfer.

Limitation of Warranty and Liability
YOU UNDERSTAND AND AGREE THAT OUR Funds Transfer SERVICE IS PROVIDED "AS-IS" EXCEPT AS OTHERWISE PROVIDED IN THIS AGREEMENT OR AS REQUIRED BY LAW, WE ASSUME NO RESPONSIBILITY FOR THE TIMELINESS, DELETION, MIS-DELIVERY OR FAILURE TO STORE ANY USER COMMUNICATIONS OR PERSONALIZATION SETTINGS. YOU UNDERSTAND AND EXPRESSLY AGREE THAT USE OF THE Funds Transfer SERVICE IS AT YOUR SOLE RISK, THAT ANY MATERIAL AND/OR DATA DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE Funds Transfer SERVICE IS DOWNLOADED OR OBTAINED AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OR THE OBTAINING OF SUCH MATERIAL AND/OR DATA. EXCEPT AS EXPRESSLY SET FORTH ON THE Altra Federal Credit Union WEB SITE OR IN THIS AGREEMENT, WE DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY OR THIRD PARTY RIGHTS, AND WE MAKE NO WARRANTY OR REPRESENTATION REGARDING THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE Funds Transfer SERVICE, THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE Funds Transfer SERVICE, THE ACCURACY OF ANY INFORMATION RETRIEVED BY US FROM THE ACCOUNTS OR THAT THE Funds Transfer SERVICE WILL MEET ANY USER'S REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE OR ERROR FREE. EXCEPT AS DESCRIBED IN THIS AGREEMENT, WE WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OF ANY KIND RESULTING FROM THE USE OF OR THE INABILITY TO USE THE Funds Transfer SERVICE, ANY INACCURACY OF ANY INFORMATION OR AMOUNT RETRIEVED BY US FROM THE ACCOUNTS, ANY BREACH OF SECURITY CAUSED BY A THIRD PARTY, ANY TRANSACTIONS ENTERED INTO BASED ON THE Funds Transfer SERVICE, ANY LOSS OF, UNAUTHORIZED ACCESS TO OR ALTERATION OF A USER'S TRANSMISSIONS OR DATA OR FOR THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLES, EVEN IF WE HAD BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Indemnification
You agree to indemnify, defend and hold harmless Altra Federal Credit Union , its affiliates, partners, officers, directors, employees, consultants, service providers and agents from any and all third party claims, liability, damages and/or costs (including, but not limited to, attorneys fees) arising from your use of the Funds Transfer Service, our reliance on the information, instruction, license and/or authorization provided by you under or pursuant to this Agreement, your violation of the Terms or your infringement, or infringement by any other user of your Funds Transfer account, of any intellectual property or other right of any person or entity.

Recipient
In the event that you are an intended Recipient, another customer (the "Transferor") has instructed us to transfer funds (the "Funds") to an account you designate at your bank or other financial institution (the "Account"). In addition to the Terms herein, you agree to accept the terms and conditions set forth below. You authorize us to transfer the Funds to your Account. In order for us to complete the transfer, you will be prompted to provide us with the following information (the "Information"): 1) your full name; 2) your current residential address; 3) the name of your bank or financial institution and ABA routing number (the 9-digit number that appears on the far left of the bottom of your check) of the financial institution which holds your Account; 4) the Account number; and 5) a secret word or phrase known only to you and the transferor. We will utilize the Automated Clearing House (ACH) system to send the Funds to your Account. We will act on the information provided by you in completing ACH credit instructions to your Account. If for any reason your financial institution returns the ACH credit or the credit goes to the wrong financial institution or Account because you have provided us with incorrect information, we may in our sole discretion, take reasonable efforts to complete the credit transaction or return the Funds to the Transferor. To enable you, and only you, to receive the Funds, the Transferor has given you the Shared Secret. If you have not received the Shared Secret, please contact the Transferor directly. The Shared Secret is stored in encrypted form by us. No one at Altra Federal Credit Union has access to the Shared Secret. No one at Altra Federal Credit Union will know or need to know the Shared Secret, and Altra Federal Credit Union employees will never ask for the Shared Secret. YOU AGREE THAT YOU WILL NOT GIVE THE SHARED SECRET TO ANYONE FOR ANY REASON. You agree that we shall not be liable for any losses that may result if you disclose the Shared Secret to another person. You agree not to impersonate any person or use a name that you are not authorized to use. You warrant and represent that you are the person intended by the Transferor and entitled to receive the Funds; that you are not a person whose Accounts are blocked under regulations of the Office of Foreign Asset Control (OFAC) of the United States Treasury Department; and that the Information you will provide is true, correct and complete. We reserve the right to decline to complete any transfer, even after you have agreed to all of the Terms, if we have reason to believe that completing the transfer would result in a violation of law or expose us to liability or risk of loss. Without limiting the foregoing, we will reject any transfer if you do not enter the Shared Secret correctly after three [3] at Funds Transfer Services. If the transfer is rejected for any reason, the funds will be returned to the Transferor.

Miscellaneous
You understand and agree that our service provider is not a bank, a broker-dealer firm, or any other kind of financial institution. You represent and warrant that you are who you claim to be; that you are the rightful owner of all Content and the Accounts linked for the purposes of the Funds Transfer Service; and that you are rightfully authorizing us to access the Accounts. You agree that our rights and remedies arising out of any breach of your representations and warranties in this Agreement, the limitations on our liability and our rights to indemnification under this Agreement are continuing and shall survive the termination of this Agreement, notwithstanding the lack of any specific reference to such survivability in these provisions. Altra Federal Credit Union's failure to enforce the strict performance of any provision of this Agreement will not constitute a waiver of Altra Federal Credit Union's right to subsequently enforce such provision or any other provisions of this Agreement. The most current version of this Agreement as it appears on our website, including any amendments that we may make from time to time, constitutes the entire agreement between us, and supersedes and replaces all other agreements or understandings, whether written or oral, regarding the Funds Transfer Service. This Agreement may be amended, or any of Altra Federal Credit Union's rights waived, only if Altra Federal Credit Union agrees in writing to such changes, or you continue using the Funds Transfer Service following receipt of notice of any changes proposed by Altra Federal Credit Union .

All notices to you shall be in writing and shall be made either via e-mail, conventional mail or messages delivered through the Services, at Altra Federal Credit Union's discretion. All notices to Altra Federal Credit Union must be made in writing and sent to Altra Federal Credit Union at 2715 Losey Blvd S, La Crosse, WI, 54601 , via registered or certified mail. This Agreement is personal to you and you may not assign it to anyone. If either of us has any dispute or disagreement with the other regarding this Agreement that we cannot resolve amicably, both parties agree that the sole and exclusive remedy shall be binding arbitration in accordance with the then-current rules and procedures of the American Arbitration Association. This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without giving effect to its conflict of laws provisions or your actual state or country of residence. If for any reason a court of competent jurisdiction finds any provision or portion of the Terms to be unenforceable, the remainder of the Terms will continue in full force and effect. This Agreement shall take effect immediately upon the acceptance of your application for the Funds Transfer Service by us.

 

 

Access 24 Online Banking Agreement & Disclosure

 

This Agreement and Disclosure ("Agreement") covers your use of Altra Federal Credit Union's Access 24 Online Banking service.

In this Agreement, the words "you" and "your" mean members, joint account owners, and authorized users of Access 24 Online Banking. The words "we," "us," and "our" mean Altra Federal Credit Union. The word "account" means any accounts you have with the Credit Union.

By using Access 24 Online Banking, you agree to all of the terms and conditions in this Agreement. All transactions done on Access 24 are also subject to the terms of the specific deposit or loan account agreements and disclosures and the current service charges schedule.

Using Access 24
You need a personal computer and access to the Internet to use Access 24. You are responsible for installation, maintenance and operation of any required software or hardware. We are not responsible for errors or failures involving any telephone or cable service, Internet service, software or hardware. We cannot provide diagnostic or technical support for your software or hardware.

Types of Transactions
At this time, you may use Access 24 Online Banking to:

  • Review account balances and transaction history
  • Transfer funds between your accounts and make loan payments
  • Transfer funds to savings, checking or loan accounts of other members whom have been pre-authorized for cross-account transfers
  • Schedule one-time or recurring transfers in the future
  • View, save or print account statements, check copies, or tax notices
  • Review Altra Credit Card balances, transactions and statements
  • Make a transfer payment from an Altra savings or checking account to your Altra Credit Card
  • Set up email notifications based on account balances, completed transfers, cleared checks, etc.
  • Export transactions to Quicken or MS Money
  • Request a withdrawal from a checking, savings, or loan account

Submit address, phone or email changes or stop payment requests

Bill Pay and Funds Transfer/Send Money
Access 24 also offers Bill Pay and Funds Transfer/Send Money options. Bill Pay is a free service that allows you to pay an unlimited number of bills online. Funds Transfer allows you to transfer funds between Altra and other financial institutions. Standard transfers into Altra are free; there is a small charge for transfers out of Altra. Send Money lets you make electronic payments to individuals without having to know any of their account information. These services have separate user agreements and disclosures. You can sign up for either through Access 24 Online Banking.

Transfers
Electronic withdrawals and/or transfers from a savings or money market account are limited by Federal regulations to a total of six (6) in any one month. This limit includes transfers or withdrawals made through Access 24, automatic payments or withdrawals, and automatic overdraft protection transfers.
The Credit Union may, at its discretion, approve a transaction that takes an account balance negative, which would incur a standard overdraft fee. The Credit Union also reserves the right to refuse a transaction that would result in insufficient funds, draw on unavailable funds, or take an account below a required minimum balance.

eStatements and Electronic Notices
By accepting the terms of this agreement, you agree to receive your periodic account statements online through our eStatement service from this point forward. Your eStatements may include the periodic account and transaction activity for your deposit and loan accounts; notices for insufficient funds, certificate maturity, and other similar account notices; year-end tax statements for dividends earned and mortgage interest paid; and any disclosures.

eStatements and notices are accessed by signing on to Access 24 and clicking on the eStatement button. We will send you an e-mail whenever a monthly statement, account notice, or tax form is available for review, as well as a link to Access 24 to access and view these documents. You will need Adobe Acrobat Reader software to read your statements, which can be downloaded at no charge from the eStatement registration screen. You will be able to access statements and other documents online for a period of 12 months. You also have the option to download or print the documents for future reference.

You have the right to request and receive your statements and other documents in paper form, and you may withdraw your consent to receive eStatements at any time. To do this, first sign on to the eStatement application, then select "change registration," and then "discontinue accounts." Select the account(s) you wish to discontinue, and click "discontinue." There are no fees or account restrictions for choosing to withdraw your consent for online statements.

Account Information Available
Access 24 maintains three months of transaction history online for all accounts. Current or new account balance, transaction, or history information is limited to available information. Accounts may show a Balance and a different Available Balance as a result of pending transactions or funds availability.

Security
You will be required to enter your User ID (your account number or an alternate User ID) and a PIN (Personal Identification Number) to access your accounts. The first time you use Access 24, you will be asked for your email address, you will be asked whether you wish to enroll in Bill Pay, and you will be asked to provide an answer to a Challenge Question that will be used for Enhanced Login Security.

Enhanced Login Security
Enhanced Login Security helps protect you against identity theft or other online fraud. Once you've provided an answer to the challenge question, you can add extra security protection to enroll the computer you are using. After you enroll a computer, you will be able to sign on from that computer without answering the Challenge Question each session. You can enroll multiple computers; we do not recommend enrolling computers you do not regularly use. When you sign on using a computer that is not enrolled, you will be asked to validate your identity by typing in the answer to your Challenge Question.

Alternate User ID
If you do not wish to use your account number as your User ID, you have the option to change it. Click on User Options, then on Change Member Number. You'll be asked to enter and verify a 6-20 character User ID with at least one lower case alphabetic character. You may change your User ID as often as you wish; however, once you change your User ID from your account number, you must continue using the 6-20 character alpha & numeric format.

Password Security

For optimal security, we recommend that you change your Password periodically. You are responsible for safeguarding your Password. You agree not to disclose or otherwise make your Password available to anyone who is not an authorized user on your accounts. You are responsible for all transfers you authorize under this Agreement. If you permit other persons to use Access 24 Online Banking or your Password, you are responsible for any transactions they authorize or conduct on any of your accounts.

Liability for Unauthorized Access
Tell us AT ONCE if you believe your PIN/password has been lost or stolen, or an unauthorized person has obtained access to your accounts without your permission. Telephoning is the best way of keeping your possible losses down. If you believe anyone has used your PIN or accessed your accounts through Access 24 Online Banking without your authorization, please contact us immediately. During business hours, call 608-787-4500 or 800-755-0055. After hours, you may email info@altra.org.

You could lose all the money in your account (plus your maximum overdraft line of credit). If you tell us within 2 business days after you learn of the loss or theft of your PIN/password, you can lose no more than $50 if someone used your PIN/password without your permission.

If you do NOT tell us within 2 business days after you learn of the loss or theft of your PIN/password, and we can prove we could have stopped someone from using your PIN/password without your permission if you had told us, you could lose as much as $500.

Also, if your statement shows transfers that you did not make, tell us at once. If you do not tell us within 60 days after the statement was mailed to you, you may not get back any money you lost after the 60 days if we can prove that we could have stopped someone from taking the money if you had told us in time. If a good reason (such as a long trip or a hospital stay) kept you from telling us, we will extend the time periods.

If your statement shows unauthorized Access 24 Online Banking transfers, notify us at once. Please refer to the last page of your statement for instructions on reporting errors or questions.

Stop Payments
You may use Online Access to place a stop payment on a check or range of checks drawn on your personal Altra Federal CU checking account. A fee will be charged to your account as listed in the current Schedule of Fees.

Credit Union's Liability for Failure to Make Transfers
If we do not complete a transfer to or from your account on time or in the correct amount according to our agreement with you and the instructions you transmit, we will be liable for your actual losses or damages.

However, we will not be liable:

  • If you do not have adequate funds in your account to complete a transaction, your account is closed, the transaction amount would exceed your credit limit on a line of credit, or if the funds in your account are subject to an administrative hold, legal process or other claim.
  • If your computer fails or malfunctions, if circumstances beyond our control (such as fire, flood, telephone outages, postal strikes, equipment or power failure) prevent making the transaction, or if Access 24 Online Banking is not working properly and the problem would have been apparent when you attempted the transaction. class="subheader"
  • If you have not given complete, correct and current instructions.
  • If there are other reasonable exceptions.

Fees and Charges
There is no charge for using Access 24 Online Banking. Some transactions or transfers may be subject to charges under the terms and conditions of that account agreement.

Account Information Disclosure
We will disclose information to third parties about your account or the transfers you make:

  • Where it is necessary for completing transfers, or
  • In order to verify the existence and condition of your account for a third party, such as a credit bureau or merchant, or
  • In order to comply with government agency or court orders, or
  • If you give us your written permission.

Please refer to our Privacy Policy for additional details. You received a copy of this document at account opening and annually in your April statement. It can also be found online at www.altra.org.

Termination of Access 24 Online Banking Services
We may terminate your use of Access 24 Online Banking if you or any authorized user of your account/PIN breaches this or any other agreement with us; or if we have reason to believe there has been unauthorized use of your account or PIN.

You or any other party to your account can terminate your use of Access 24 by calling or writing to us. However, termination of the system will not affect the rights and responsibilities of the parties under this Agreement for transactions initiated before termination.
